Vakar vykusiame renginyje-diskusijoje „Privatumo ribos Bendrojo duomenų apsaugos reglamento kontekste“, kurį organizavo Teisėjų taryba bei Visuomenės informavimo etikos asociacija. Renginio metu dalinomės savo įžvalgomis apie BDAR taikymą nepažeidžiant svarbiausių vertybių.
Priešingai nei teisės į privatumą atveju, BDAR neturi aiškiai apibrėžtos vertybių sistemos, kurią saugo reglamentas. Todėl BDAR sudaro prielaidas taikyti teisės aktą paminant vertybes ir tokiu būdu mesti iššūkį žodžio laisvei, verslo laisvei ir technologinei pažangai. Kaip priemones šiai vertybinei problemai spręsti siūlome teisėto intereso tvarkyti asmens duomenis gynimą, atsisakyti iliuzijų dėl sutikimo svarbos ir subalansuoti duomenų teikiamą pridėtinę vertę su pavojais, kylančiais asmenims.

Yesterday, we shared our insights on applying the GDPR without undermining core values at the event "Privacy Boundaries in the context of the General Data Protection Regulation".
We argue that contrary to the right to privacy, GDPR lacks a clearly defined system of values protected by the regulation. Therefore, GDPR is open to the application of the law in the value-less fashion and challenging free speech, business freedom & technological progress. To address this issue, we suggest enforcing the legitimate interest to process personal data, giving up illusions on the importance of consent, and balancing the added value brought by the data against the dangers to individuals.
The event featured presentations and insights from the European Data Protection Supervisor Wojciech Wiewiórowski, as well as judges of the highest courts and other data protection law experts.
