We are pleased that our proposal to the Ministry of Justice to review and liberalise the legal regulation of the processing of criminal record data of candidates and employees has been included in the Ministry of Justice's draft amendments to the Law on Legal Protection of Personal Data (ADTAĮ).
In our view, Lithuania‘s national data protection regulatory policy should take advantage of the areas that the #GDRR leaves to national regulation by Member States and shall not impose stricter standards than the GDPR.
If our proposed amendments are adopted, businesses will have the opportunity to carry out criminal background checks of candidates and employees when they are necessary for the legitimate interests of the employer.
Until now, such checks have only been allowed in cases where it was necessary to verify that a person complied with the statutory requirements for the performance of his/her job functions.

Džiaugiamės, kad mūsų pasiūlymas Teisingumo ministerijai peržiūrėti ir liberalizuoti kandidatų ir darbuotojų teistumo duomenų tvarkymo teisinį reguliavimą buvo įtrauktas į Teisingumo ministerijos parengtą Asmens duomenų teisinės apsaugos įstatymo pakeitimo projektą.
Mūsų nuomone, Lietuvos nacionalinė duomenų apsaugos reguliavimo politika turėtų pasinaudoti sritimis, kurias GDPR palieka valstybių narių nacionaliniam reguliavimui, ir neturėtų nustatyti griežtesnių standartų nei GDPR.
Jei mūsų siūlomos pataisos bus priimtos, įmonės turės galimybę tvarkyti kandidatų ir darbuotojų teistumo duomenis (atlikti background checks), kai toks tvarkymas būtinas dėl teisėtų darbdavio interesų.
Iki šiol tvarkyti kandidatų ir darbuotojų teistumo duomenis buvo leidžiama tik tada, kai tai buvo būtina siekiant patikrinti, ar asmuo atitinka įstatymuose ir įstatymo įgyvendinamuosiuose teisės aktuose nustatytus reikalavimus pareigoms ar darbo funkcijoms atlikti.
